Read these Terms carefully before using The Growers Guild. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms of Use ("Terms") govern your access to and use of The Growers Guild platform ("the Platform" or "the Service"). These Terms are between you ("User," "you," or "your") and L Lavatio Botanicus Co., a Maryland corporation doing business as The Growers Guild. The Growers Guild is a trade name of L Lavatio Botanicus Co., not a separate legal entity. References to "we," "us," "our," or "the Platform" mean L Lavatio Botanicus Co. and its service providers and affiliates. By accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to these Terms, including the policies incorporated by reference below. Your electronic consent is recorded with a timestamp and the version of these Terms in effect at the time you accept.
If you use the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The Platform is intended exclusively for adults who are 21 years of age or older. By registering or using the Platform, you self-certify that you are at least 21 years old and legally able to enter into a binding contract. This is a self-certification, not third-party identity or age verification. We do not knowingly collect information from anyone under 21. If you learn that anyone under 21 has accessed the Platform, please report it through our Help & Support page.
The Growers Guild is an educational and community platform for adults 21+ that provides:
The Platform does not sell, distribute, arrange, deliver, or broker cannabis, cannabis seeds, or any controlled substance.
The cultivation, possession, use, and distribution of cannabis and other plants may be illegal under federal, state, provincial, national, or international law. These laws vary widely by jurisdiction and change over time. Federal and local law may conflict.
You are solely responsible for understanding and complying with all laws applicable to you before using the Platform or engaging in any cultivation activity. The Platform does not provide legal advice and does not guarantee that any activity is lawful in your jurisdiction.
You agree not to use the Platform to:
The Classifieds section is a community bulletin board limited to lawful, non-controlled horticultural equipment and supplies (e.g., lights, pots, nutrients, tools). You may not list cannabis, seeds where unlawful, controlled substances, ingestibles, weapons, stolen goods, or regulated goods.
The Platform is not a party to, broker of, escrow agent for, seller in, or payment processor for any transaction between users. All transactions are solely between buyers and sellers as independent private parties. We do not guarantee the legality, quality, safety, authenticity, or fitness of any item listed. Each user is solely responsible for ensuring any transaction is lawful in their jurisdiction and the jurisdiction of any counterparty. See our Marketplace Rules.
You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate information, not to share your credentials, and to notify us promptly through Help & Support if you suspect your account has been compromised. You control only your own account; you may not access or use another user's account.
You retain ownership of content you upload to the Platform, including posts, photos, journal entries, comments, and other materials ("User Content"). You grant the Platform a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, technically adapt (e.g., format conversion or compression), and distribute your User Content solely as needed to operate the Platform and your selected visibility and sharing settings.
This license ends when your User Content is deleted from the Platform, except for copies retained in backups, content required to be retained by law or for legitimate moderation/legal purposes, and content that has been shared or reposted by other users. We do not intentionally use your User Content to train a Guild-owned general-purpose AI model. Your submissions to AI features are processed as described in our Privacy Policy and AI & Horticultural Disclaimer under the configured provider terms. Any materially broader use of your User Content will require clear notice and, where required, your affirmative consent.
You represent that:
We may moderate User Content and user conduct at our discretion. Moderation actions may include warnings, content removal, posting restrictions, temporary suspension, or permanent ban. We may take emergency action without notice where we believe it is necessary to protect users, the Platform, or third parties. We may preserve content or data where required by law.
Moderation is not guaranteed, does not make us a publisher or sponsor of user conduct, and does not create an obligation to monitor all content. If you believe moderation action was taken in error, you may appeal through Help & Support. See our Community Standards.

The Living Record is a user-created PDF export of your cultivation record. It is not a compliance certificate, chain-of-custody record, laboratory result, legal proof, or ownership verification.
The Platform may contain links to or integrate with third-party services. Their terms and privacy policies apply to your use of those services. We do not endorse and are not responsible for third-party content, products, or services.
The Platform's name, logo, design, and original content (excluding User Content) are owned by L Lavatio Botanicus Co. d/b/a The Growers Guild. You may not use our trademarks or brand without prior written consent. User Content remains the property of its creator as described in Section 8.
If you believe content on the Platform infringes your copyright, you may submit a notice as described in our Copyright & DMCA Policy. We respond to valid notices in accordance with applicable law.
We may suspend or terminate your access to the Platform for violation of these Terms or applicable law. Where reasonably practicable, we will provide you with notice and the reason for the action. We may take immediate action without notice where we believe it is necessary to protect users, the Platform, third parties, or applicable law. You may stop using the Platform at any time and may request account deletion through Account Deletion. Access to our Help & Support, Privacy Policy, and Account Deletion pages remains available to you. Upon termination, your right to use the Platform ends. Sections that by their nature should survive termination — including ownership, indemnity, limitation of liability, and dispute provisions — will remain in effect.
The Platform offers an optional paid membership. If you purchase a subscription, the price, renewal terms, cancellation policy, and refund terms will be displayed to you before purchase. You authorize recurring billing at the displayed interval until you cancel. Taxes may apply. See our Subscription Terms and Refund Policy.
To the fullest extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, or security. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, neither L Lavatio Botanicus Co. nor its operators, service providers, or affiliates shall be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to these Terms or your use of the Platform, even if advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the total aggregate liability of L Lavatio Botanicus Co and its affiliates to you for all claims arising out of or relating to these Terms or the Platform shall not exceed the amount you paid us, if any, in the twelve months preceding the claim, or one hundred U.S. dollars ($100.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law. Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless L Lavatio Botanicus Co. and its operators, service providers, and affiliates from third-party claims arising out of or relating to (a) your User Content, (b) your unlawful conduct, or (c) your material breach of these Terms. You agree to promptly notify us of any claim, give us reasonable control of its defense, and cooperate with us in that defense. This indemnity does not apply to claims arising from our own gross negligence or willful misconduct where such exclusion is required by applicable law.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles. This governing-law clause does not waive any non-waivable rights or mandatory consumer protections you may have under applicable law. Any dispute arising out of or relating to these Terms or the Platform may be brought in the courts located in the State of Maryland, to the extent permitted by law and consistent with any non-waivable rights you may have. We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date and, where legally required, we will provide clear advance or in-app notice and require your renewed affirmative acceptance before you may continue using authenticated features. Your continued use after such notice constitutes acceptance only where legally permitted. We will not retroactively change the license terms for User Content you have already uploaded under a prior version of these Terms.
Severability: If any provision is found unenforceable, the remaining provisions continue in full force. Assignment: You may not assign these Terms without our consent; we may assign them to a successor. No Agency: No user is an agent, employee, or partner of the Platform by virtue of using it. Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control. Entire Agreement: These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and L Lavatio Botanicus Co. regarding the Platform.
